GENERAL TERMS AND CONDITIONS OF SALE

These terms and conditions of sale are entered into by the company MBTJM (for the brand NITTO KNITWEAR), with a share capital of €10,000, whose registered office is located in Clamart, registered with the Nanterre Trade and Companies Register under number 808.641.435, hereinafter referred to as NITTO KNITWEAR and managing the website www.nittoknitwear.com, and, on the other hand, by any natural or legal person wishing to make a purchase via the website www.nittoknitwear.com, hereinafter referred to as "the buyer."


Article 1. Object:

These terms and conditions of sale aim to define the contractual relationship between NITTO KNITWEAR and the buyer, as well as the conditions applicable to any purchase made through the website www.nittoknitwear.com. The acquisition of a product through this site implies the buyer's full acceptance of these terms and conditions, which the buyer acknowledges having read prior to placing the order. Before any transaction, the buyer declares that, on the one hand, the purchase of products on the website www.nittoknitwear.com is not directly related to their professional activity and is limited to strictly personal use, and on the other hand, that they have full legal capacity to enter into an agreement under these general terms and conditions of sale.

NITTO KNITWEAR reserves the right to modify these terms and conditions at any time in order to comply with new regulations or to improve the use of its site. Therefore, the applicable conditions will be those in effect on the date of the buyer’s order.

 

Article 2. Product:

The products offered are those listed on the website www.nittoknitwear.com by NITTO KNITWEAR, subject to availability. NITTO KNITWEAR reserves the right to modify the product range at any time. Each product is presented on the website with a description highlighting its main technical features (composition, size, color). The photographs are as accurate as possible but do not bind the Seller in any way. The sale of products presented on the website www.nittoknitwear.com is intended for all buyers residing in countries that fully permit the entry of these products into their territory.

 

Article 3. Pricing:

The prices listed on the product pages of the online catalog are in Euros (€) inclusive of all taxes (TTC), taking into account the VAT applicable on the day of the order. Any changes in the VAT rate may be reflected in the price of the products.

The items ordered must be paid for in euros and online. Any bank charges related to the payment are the responsibility of the customer.

The goods delivered remain the property of the seller until full payment is received.

NITTO KNITWEAR reserves the right to change its prices at any time, with the understanding that the price listed in the catalog on the day of the order will be the only applicable price for the buyer. The listed prices do not include delivery fees, which are billed in addition to the price of the purchased products depending on the total amount of the order.

In France and Belgium, for any order equal to or greater than €180 including VAT, shipping costs are free; for any order less than €180 including VAT, a flat-rate contribution to shipping costs will be charged to the buyer: €4 including VAT for pickup delivery and €6 including VAT for home delivery.

For orders to overseas territories, a shipping fee of 10 euros TTC will be charged.

For orders to Europe (excluding Switzerland), a shipping fee of 10 euros TTC will be charged.

For orders to Switzerland and other countries worldwide, a shipping fee of 25 euros TTC will be charged.

 

Article 4. Order and Payment Terms

 

Before placing an order, the buyer must create an account on the website www.nittoknitwear.com. The account creation section is directly accessible from the sidebar menu. On each visit, if the buyer wishes to place an order or consult their account (order status, profile…), they must log in with their credentials.

The items displayed on the site are available until stocks run out. In the event of a charge or collection for an out-of-stock item, NITTO KNITWEAR commits to offering a store credit or refunding the customer within 14 days. NITTO KNITWEAR will notify the customer via email if they have ordered an out-of-stock item.

NITTO KNITWEAR reserves the right to cancel any order from a customer with whom there is a dispute regarding payment for a previous order or in the case of an error in payment or order that may have resulted from a mistake.

Any order placed using a discount code or promotion will be non-exchangeable and non-refundable.

NITTO KNITWEAR offers the buyer the option to order and pay for their products in multiple steps:

1/ The buyer selects the product(s) they wish to purchase by choosing the model/color/size.

2/ They click "order." The product is added to their cart (they can modify their order at any time before payment).

3/ They log in by providing their email address, the preferred delivery method (relay point, home delivery, or in-store pickup), and the delivery address.

4/ They choose a secure payment method: by credit card or via their PAYPAL account.

  • If paying by credit card: they enter the necessary payment details (card number, expiration date, security code, cardholder's name), then click "Pay Now."
  • If paying via their PAYPAL account:

The next step will ask the buyer to verify all details, acknowledge and accept the terms and conditions by ticking the corresponding box, then confirm their order by clicking "Confirm my order."

The buyer will be redirected to the secure PAYPAL interface to enter their PAYPAL account details securely. If the payment is accepted, the order is recorded, and the contract is definitively formed.

Payment by PAYPAL or credit card is irrevocable. In the case of fraudulent use of the card, the buyer may request the cancellation of the payment by card, and the amounts paid will then be refunded or reimbursed. The cardholder's liability is not engaged if the disputed payment was made fraudulently, remotely, without the physical use of the card. To obtain a refund of the fraudulent charge and any related banking fees, the cardholder must contest the debit in writing with their bank within 70 days of the transaction, or up to 120 days if their contract with the bank allows. The amounts debited will be refunded by the bank within one month after receiving the written contestation from the cardholder. No fees for the refunding of the sums will be charged to the cardholder.

The confirmation of an order implies acceptance of these terms and conditions, acknowledgment of full knowledge of them, and renunciation of applying their own purchasing conditions. All provided data and the confirmation recorded will serve as proof of the transaction.

Article 5. Retention of Title

NITTO KNITWEAR retains full ownership of the products sold until full payment is received, including principal, fees, and taxes.

 

Article 6. Right of Withdrawal

Under Article L121-20 of the French Consumer Code, the buyer has a period of fourteen working days from the delivery of their order to exercise their right of withdrawal and return the product to the seller for exchange or refund without penalty, except for return shipping costs.

Any return must be made in its original packaging, in its original condition, unused, unwashed, and ideally accompanied by the delivery note received with the order.

In the case of the right of withdrawal, NITTO KNITWEAR will refund the customer the price of the returned items. The refund will be processed within 14 days after NITTO KNITWEAR has been informed of the buyer's decision to withdraw. In any case, the refund cannot occur before NITTO KNITWEAR has received the returned items or proof of their return. The refund will be made according to the payment method used for the order, unless the buyer agrees with NITTO KNITWEAR on a different method. Refunds cannot be issued if the returned item has suffered depreciation due to handling other than what is necessary to establish its nature, characteristics, or compliance.

 

Article 7. Delivery

Items are delivered within 4 to 5 working days from the order date within mainland France. This period is indicative and may vary depending on product availability and transporters.

Deliveries are made to the address provided during the order, which must be within the agreed geographical area. Orders are delivered either:

  • By La Poste via COLISSIMO, a tracked delivery service without signature. Delivery times are only indicative; if they exceed thirty days from the order date, the sales contract may be canceled, and the buyer will be refunded. NITTO KNITWEAR may provide the buyer with the tracking number for their parcel by email. The buyer is delivered at home by the mail carrier. In the case of the buyer's absence, a delivery notice will be left, allowing the buyer to collect the items from the nearest post office within a specified period. The risks related to transportation are borne by the buyer once the items leave NITTO KNITWEAR's premises. The buyer is required to check the state of the packaging and contents upon delivery in the presence of the postal worker or delivery person. In case of damage during transport, any complaint must be made to the carrier within three days of delivery.

  • By Mondial Relay to a relay point: The parcel will be delivered to the designated relay point or the address provided by the buyer at the time of order. Depending on the provided details, the customer/recipient will be notified of the parcel's arrival via email and/or SMS. If delivery to the original relay point is impossible, Mondial Relay may redirect the parcel to the nearest available relay point and notify the recipient. No refund or compensation will be provided by Mondial Relay in this case.

The customer is informed and accepts that their email address and/or phone number may be shared with Mondial Relay for the proper execution of transport operations.

Risk transfer occurs at the time of delivery of the goods.

NITTO KNITWEAR is not liable for non-performance of the contract due to force majeure, including but not limited to war, riots, strikes, transport disruptions, import issues, fire, earthquake, storm, or flood.

 

Article 8. Warranty

All products provided by NITTO KNITWEAR are covered by the legal warranty provided by Articles 1641 and following of the Civil Code. In case of non-compliance of a sold product, it can be returned to NITTO KNITWEAR, who will either replace it, exchange it, or refund it. All complaints, requests for exchanges or refunds must be made by email to: info@nittoknitwear.com within 14 days of receipt, or by mail to:

Article 9. Liability

NITTO KNITWEAR, in the process of distance selling, is only bound by a best-efforts obligation. Its liability cannot be engaged for any damage resulting from the use of the Internet, such as data loss, intrusion, viruses, service interruption, or other unintentional problems.

Article 10. Intellectual Property

All elements of the website www.nittoknitwear.com are and remain the intellectual and exclusive property of NITTO KNITWEAR. No one is authorized to reproduce, exploit, or use any elements of the site, even partially, whether in the form of photos, logos, visuals, or text.

Article 11. Personal Data

NITTO KNITWEAR is committed to preserving the confidentiality of information provided by the buyer, which they may need to transmit for the use of certain services. All information concerning the buyer is subject to the provisions of Law No. 78-17 of January 6, 1978. As such, the user has the right to access, modify, and delete their information. Article 12. Disputes and Applicable Law

These distance selling conditions are subject to French law. In the event of any disputes or litigation, the competent court will be the Commercial Court of Nanterre.
